The Types of Workers and Situations Not Covered under Workers’ Comp

Although workers’ compensation laws differ from state to state, Virginia requires that all employers with at least three regularly employed workers or more must carry workers’ compensation insurance. When considering a workers’ compensation insurance plan, it’s helpful to know that the law does not require you to cover all workers. For instance, independent contractors, domestic workers in private homes and volunteers typically aren’t required to be covered by workers’ compensation insurance. Additionally, workers’ compensation plans are not required to cover assaults by a co-worker or a third party if the assault was directed at the employee in his or her individual capacity rather than in their capacity as an employee.
